Ms Dos Santos (hereinafter referred to as the accused), is a 28-year-old Mozambican national. She was convicted in the regional court (“the trial court”) on three counts of contravening section 71(6)(a) of the Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007, read together with a number of further sections of Act 32 of 2007*, in that she unlawfully trafficked three females (“the complainants”) from Maputo in Mozambique to Pretoria where they worked as prostitutes.
The accused's convictions on the three counts supra were taken together for the purposes of sentencing and she was sentenced to life incarceration. The accused was further also convicted on one count of contravening section 17(5) of Act 32 of 2007, read together with a number of further sections of Act 32 of 2007, including those dealing with living from the earnings of the sexual exploitation of a child. On this count, the accused was sentenced to 12 months' incarceration.
Not satisfied with this heavy sentence, the accused appealed to the High Court in Pretoria (“the court of appeal”), but only against her sentence of life incarceration.
