The accused, who was 33 years of age at the time of sentencing before the regional court in Tzaneen in Limpopo, was convicted on 12 very serious charges whereupon he and his co-accused, were each sentenced to an effective term of 52 years’ incarceration.

On appeal before a full bench of five judges of the Supreme Court of Appeal in Bloemfontein (“the SCA”), the SCA unanimously held that an effective sentence of 52 years' incarceration “is shockingly inappropriate and warrants interference [by the SCA]”. The SCA, inter alia, argued that the accused will be 85 years old when he has completed his sentence of 52 years’ incarceration.
