- S V Masoanganye and Others 2015 (2) SACR 577 (NWM)
Five accused persons were convicted and sentenced by a single judge before the High Court in Mahikeng in the North West Province on charges of theft, all in respect of amounts stolen from the Guardian Fund (Afrikaans: “Voogdyfonds”). The convictions and sentences were as follows:
Accused 1: Mr Andries Joe Masoanganye who was the Master of the High Court in Mahikeng, was convicted of five counts of theft involving R1.2 million. He was sentenced to an effective ten years’ incarceration.
Accused 2: Mr Abdul Kader Ahmed who was a legal practitioner, was convicted of two counts of theft involving R294 000. He was sentenced to an effective six years’ incarceration.
Accused 3: Ms Tlaleng Alina Mhlekwa who was the Assistant Master of the High Court in Mahikeng, was convicted on one count of theft involving R181 000. She was sentenced to an effective four years’ incarceration.
Accused 4: Mrs Grace Keatlaretse Mooketsi was convicted only in respect of count 2 in that it was found that she colluded with accused 1 supra. She was sentenced to pay a fine of R3000 or three years’ incarceration.
